NOTICE OF REQUEST FOR WAIVER OF THE COMMUNITY ENERGY PROGRAM

NOTICE OF REQUEST FOR WAIVER OF THE COMMUNITY ENERGY PROGRAM

The REGULATORY COMMISSION OF ALASKA (Commission) gives notice that on May 22, 2026, Alaska Power Company (APC) filed a request for waiver of the Community Energy Program requirements in 3 AAC 50.950 - 3 AAC 50.999 for its Rate Groups 1, 2 and 4, until each rate group reaches 10,000 retail customers. Docket U-26-016 was opened to address this matter.

The Commission adopted regulations implementing the Community Energy Program for economically regulated electric utilities that are subject to net metering requirements. These electric utilities are required to make community energy programs available to subscriber organizations requesting interconnection of a community energy facility, and allow the interconnection of eligible community energy facilities under interconnection standards approved by the Commission. The electric utilities must submit for Commission approval the following:

(1) a community energy tariff with subscriptions available only to retail consumers or member owners of the utility and

(2) the maximum nameplate capacity for eligible community energy facilities within the utility's service area.

The Commission may approve or deny, in whole or in part, APC's request for waiver. The Commission may set conditions for approval.
