By Delegated Act C(2025)03801 of 28 August 2025, the Commission decided to amend the definition of 'controversial weapons' in Delegated Regulation (EU) 2020/1818 and replace it with the definition of 'prohibited weapons' (which is clearer as it is defined in international treaties), so as to ensure legal certainty and consistency across the sustainable finance rulebook and harmonised practices by benchmark administrators.

However, the Q&A document published by the Commission on 20 November 2025 on the revision of the Sustainable Finance Disclosure Regulation continues to use the term 'controversial weapons' (page 2, exclusion criteria for 'transition categories'), while the 'sustainable category' does refer to 'prohibited weapons'.

This difference in terminology within the same document creates an apparent inconsistency and risks creating confusion among stakeholders in the sector.

  • 1.Can the Commission clarify whether the retention of the term 'controversial weapons' in this document of 20 November 2025 is the result of a drafting oversight or a deliberate decision?
  • 2.If this decision is deliberate, what are the reasons and how does the Commission intend to ensure the uniform application of the term 'prohibited weapons', as provided for in Delegated Act C(2025)03801?
