IDHR Temporarily Withdraws Proposed Rules Related to AI Notice Requirements in Employment Decisions

CHICAGO-The Illinois Department of Human Rights (IDHR) announced today, June 2, 2026, that the public hearing scheduled for June 10, 2026, regarding proposed administrative rules implementing the Artificial Intelligence in Employment provisions of the Illinois Human Rights Act has been temporarily postponed.

However, IDHR is currently reviewing matters related to the proposed rulemaking and will provide updated information regarding next steps as it becomes available. Postponement is necessary to allow for continued collaboration with other state agencies.

The law requires that employers using artificial intelligence and automated decision-making systems in hiring and employment must provide transparency through notices and ensure these systems don't result in discrimination against protected classes.

Note: The Department originally announced on Friday, May 15, 2026, that proposed amendments to Public Act 103-804 have been published in the Illinois Register, beginning the formal public comment process under the Illinois Administrative Procedure Act.
