Cahill secured the dismissal of all claims brought against Deutsche Bank AG and Deutsche Bank Trust Company Americas in a lawsuit alleging violations of the Trafficking Victims Protection Reauthorization Act (TVPRA).
The plaintiffs, the surviving family members of three individuals abducted and murdered by terrorists, sought to obtain monetary damages from Deutsche Bank under the TVPRA by alleging that the bank indirectly funded the terrorist activity which eventually led to the injury and death of the victims. While strongly condemning the acts of the terrorists, Deutsche Bank argued that that the plaintiffs improperly sought to hold Deutsche Bank financially responsible for the terrorists' crimes. In dismissing the complaint, the United States District Court for the Southern District of New York agreed with the Cahill team's argument on a motion to dismiss that the plaintiffs failed to allege that Deutsche Bank participated in or benefitted from any venture with the terrorists responsible for these crimes or had knowledge that any of its customers were involved in a trafficking venture.
