On December 18, Senior Attorney Young-Soo Choi, Attorney Sung-Eun Ahn, and Foreign Attorney David K. S. Oh of Dentons Lee delivered a joint presentation at Green Consulting Day, hosted by the Korea Environmental Industry & Technology Institute, highlighting representative legal advisory matters supporting clients' cross-border growth strategies and international market entry in the green and environmentally sustainable industries.
Green Consulting Day was convened to strengthen the global competitiveness of companies operating in the environmental and green industry sectors and to facilitate coordination with relevant public policy initiatives. The program drew participation from stakeholders across the environmental and green technology sectors. In this forum, Dentons Lee introduced three representative cross-border advisory engagements: advising biotechnology and cosmetics companies on entry into the Japanese market; advising a company on the structuring and negotiation of international distribution arrangements for eco-friendly HVAC solutions; and advising a company pursuing expansion into Singapore and the broader Asia-Pacific region based on marine environmental remediation robotics technology.
Senior Attorney Young-Soo Choi, Attorney Sung-Eun Ahn, and Foreign Attorney David K. S. Oh discussed key legal and regulatory considerations arising in cross-border trade and distribution, including the analysis of applicable domestic and foreign regulatory regimes, customs and import/export compliance, product labeling, and licensing requirements. They also addressed the structuring, negotiation, and risk allocation of English-language distribution and supply agreements with international counterparties, with a focus on managing legal risk in cross-border commercial arrangements. In addition, drawing on advisory experience relating to the establishment and operation of international subsidiaries, capital contributions and increases, procedures for obtaining government incentives and subsidies, foreign exchange and cross-border payment regulations, and engagement with local regulatory and administrative authorities, the presenters highlighted legal and institutional issues that commonly arise in the course of international expansion and outlined practical approaches for navigating these issues in a global operating environment.
