New Update to the Department of Justice Guide to the Freedom of Information Act

OIP is pleased to announce an update to the Exemption 5 section of the Guide has been published!

The United States Department of Justice Guide to the Freedom of Information Act is a comprehensive legal treatise on the FOIA. The Guide consists of detailed discussions of a number of topics related to the FOIA, including procedural requirements, all nine exemptions, litigation considerations, and more. Each section contains a detailed analysis of key judicial opinions issued on the FOIA. As such, the Guide is updated by OIP on a rolling basis as significant new developments occur.

The Exemption 5 section covers many topics, including attorney work-product privilege, attorney-client privilege, deliberative process privilege, and more subjects. The new section can be viewed and downloaded here.

Users can also read and download other sections of the Guide here. In addition to the Guide, OIP routinely summarizes new FOIA court decisions on its OIP's Court Decisions page. Court decisions are keyword searchable as well as searchable by topic, including Guide section topics.
