October Begins with Nearly 300 New Federal Immigration Cases in Western District of Texas

SAN ANTONIO - Federal prosecutors in the Western District of Texas filed 289 new immigration and immigration-related criminal cases from September 25 through October 1, announced U.S. Attorney Justin R. Simmons. Charges were brought against alien smugglers and illegal aliens with past convictions for child sex crimes, numerous DWIs, violent crimes, and numerous prior removals.

Among the new cases, Wilber Rafael Garces-Perez, an illegal alien from Venezuela, was arrested in Austin and charged with one count of assaulting, resisting, interfering, and impeding a federal officer. A criminal complaint alleges that Garces-Perez ignored the orders from Immigration and Customs Enforcement (ICE) Enforcement Removal Operations (ERO) officers to place his vehicle in park and step out during a traffic stop. The complaint alleges and body camera footage shows that after further direction from the officers in Spanish, Garces-Perez abruptly closed his car window and drove off, striking one of the ICE ERO officers in the torso with his driver's side-view mirror.

Near Del Rio, U.S. Border Patrol agents arrested an illegal alien from Mexico, Diego Armando Victorio-Adame. Victorio-Adame has been deported four times and is now charged with illegal re-entry. He was convicted of a felony in 2022 for possession of a controlled substance. Victorio-Adame has also been previously convicted of two DWIs and assault causing bodily injury.

An illegal alien and convicted sex offender from Guatemala was charged with illegal re-entry in El Paso. Jaime Felipe Batres was arrested near Fort Hancock after just being removed from the U.S. in August. In September 2025, Felipe Batres was convicted of indecent assault and corruption of minors in Philadelphia, Pennsylvania.

Javier Nicolas Francisco-Francisco, also an illegal alien from Guatemala, was arrested just over three miles west of the Paso Del Norte Port of Entry on Thursday. Francisco-Francisco was deported for the second time in 2023 through Phoenix, Arizona. He's been convicted of three felonies since 2014, including operating a motor vehicle without a valid license and aggravated assault with a weapon.

In San Antonio, Roberto Guerrero-Cano, an illegal alien from Mexico, was encountered by ICE ERO officers at the Bexar County Jail after he was convicted of a DWI on Sept. 25. Guerrero-Cano was previously removed from the U.S. in 2014 following an illegal re-entry conviction. In 2010, he was convicted of assault causing bodily injury and possession of prohibited weapons. Guerrero-Cano now faces another illegal re-entry charge.

These cases were referred or supported by federal law enforcement partners, including ICE, U.S. Border Patrol, the Drug Enforcement Administration (DEA), the FBI, the U.S. Marshals Service (USMS), and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), with additional assistance from state and local law enforcement partners.

The U.S. Attorney's Office for the Western District of Texas comprises 68 counties located in the central and western areas of Texas, encompasses nearly 93,000 square miles and an estimated population of 7.6 million people. The district includes three of the five largest cities in Texas-San Antonio, Austin and El Paso-and shares 660 miles of common border with the Republic of Mexico.

Indictments and criminal complaints are merely allegations and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

These cases are part of Operation Take Back America a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.
