HONOLULU - The Hawai'i Department of Health (DOH) Office of Health Care Assurance (OHCA) has issued an order against Lan Chen, Home Care Hawaii Inc., doing business as (dba) Aina Haina ARCH, following enforcement action for serious and substantiated violations of Hawaiʻi Administrative Rules (HAR) Chapter 11-100.1.
DOH nurse consultants confirmed that Chen unreasonably confined one adult residential care home (ARCH) resident of Aina Haina ARCH in a locked car under full sun and left without caregiver supervision for one hour and 20 minutes. No injuries were sustained and hospitalization was not required.
Aina Haina ARCH has been assessed a $1,000 administrative penalty.
Lan Chen and Home Care Hawaii Inc., dba Aina Haina ARCH, have 20 days from the date of receipt of the order to submit a written request for a hearing. If no request is submitted, the order will become final and enforceable after the 20-day period.
The DOH Office of Health Care Assurance, State Licensing Section, licenses and regulates adult residential care homes to ensure the health, safety and welfare of individuals residing in licensed health care facilities.
