This opinion considers the effects of the demolition of existing floats and piles, in-water pile driving of steel piles and the placement of fill in marine waters, construction vessel traffic, and support operations.
These actions may affect the following endangered or threatened species and critical habitats: the North Pacific right whale and their critical habitat; Mexico Distinct Population Segment humpback whale and their critical habitat; Western North Pacific DPS humpback whale and their critical habitat; Central American DPS humpback whale and their critical habitat; blue whale; fin whale; sperm whale; Sei whale; Western North Pacific DPS gray whale; Cook Inlet beluga whale and their critical habitat; Southern resident DPS killer whale and their critical habitat; Western DPS Steller sea lion and their critical habitat; and the proposed threatened sunflower sea star.
This opinion is based on information provided by in the Biological Assessment provided by the MARAD's non-federal designee, PND, as well as the IHA Application and Proposed IHA (90 FR 46812, September 30, 2025). Other sources of information relied upon include consultation communications (emails and virtual meetings), recent consultations completed in the same region, previous monitoring reports, and marine mammal surveys conducted in and around Yakutat Bay.
