Developments in Cruise Ship Litigation

On September 10, Golden Anchor, L.C. (doing business as Harborside Pier) filed a complaint in Hancock County Superior Court challenging Chapter 52, the Cruise Ship Disembarkation Ordinance. The Council adopted Chapter 52 in June 2024 to implement Chapter 125-77H, the Land Use Ordinance provision limiting cruise ship disembarkation that was enacted by a citizen initiative in November 2022.

On September 18, Justice Thomas R. McKeon of the Maine Business and Consumer Docket of the Maine Superior Court granted the Town's motion to dismiss a complaint from resident Charles Sidman that arose out of the Bar Harbor Board of Appeals' decision to deny his administrative appeal concerning the Council's March 6th statement related to the enforcement of Chapter 125-77H. Only one claim remains pending in an earlier lawsuit filed by Mr. Sidman related to that same March 6th statement.
