ANACOM has published its report on the Open Internethttps://www.anacom.pt/render.jsp?contentId=1852423, reflecting the supervisory and monitoring activities carried out by the Authority between 1 May 2025 and 30 April 2026 with regard to the application of articles 3 and 4 of the Regulation (EU) 2015/2120 (UE)https://www.anacom.pt/render.jsp?contentId=1373317 of the European Parliament and of the Council of 25 November 2015 (the Open Internet Regulation), also following the Guidelines of the Body of European Regulators for Electronic Communications (BEREC) for its implementation https://berec.europa.eu/eng/document_register/subject_matter/berec/regulatory_best_practices/guidelines/10280-berec-guidelines-on-the-implementation-of-the-open-internet-regulation.
Of the activities carried out by ANACOM during the period under review, particular mention should be made of the monitoring which this Authority continued to carry out of information published by Internet Access Service Providers (ISPs) on their websites, and of the information included in the copies of contracts filed with ANACOM, in compliance with paragraphs 1 and 2 of article 121 of the Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=1737530, in order to ensure the transparency of the information provided to end users, as has been the practice in recent years.
Particularly noteworthy are the measures taken alongside the ISPs to promote greater transparency in the information provided to end users, in line with article 4 of the Open Internet Regulationhttps://www.anacom.pt/render.jsp?contentId=1373317. This applies to both their websites and their contracts.
ANACOM continued to receive and analyse complaints sent directly to the Authority, including those relating to Internet access services (IAS).
ANACOM continued to use NET.mede https://netmede.pt/ as an important tool for monitoring IAS quality, regularly releasing reports on the main results of user-conducted tests.
In addition, ANACOM has been monitoring developments in the IAS and Over-The-Top (OTT) services to ensure that non-discriminatory IAS services continue to be available and that their quality standards reflect technological progress.
Within the scope of its duties relating to the application of the Open Internet Regulation, this Authority will continue to monitor compliance with the relevant provisions, by monitoring the commercial offers of ISPs, the information disclosed on their websites and the contractual conditions applied.
This report, as well as its submission to the European Commission and the Body of European Regulators for Electronic Communications (BEREC), in accordance with paragraph 1 of article 5 of the Open Internet Regulationhttps://www.anacom.pt/render.jsp?contentId=1373317, was approved by ANACOM decision of 23 June 2026.
