Decrying Rollback of Mifepristone Access

(WASHINGTON, D.C.) - Today, the Fifth Circuit Court of Appeals issued a decision significantly limiting nationwide access to mifepristone, a safe and effective medication used in abortion and miscarriage care. The decision in Louisiana v. FDA forces the Food and Drug Administration (FDA) to reinstate a medically unnecessary in-person dispensing requirement that prevents patients from filling their prescriptions by mail or at a local pharmacy.

While there are other safe and effective medication abortion regimens that may be available by mail and at pharmacies, mifepristone has long been part of the most common and recommended protocol in the United States and is used in nearly two-thirds of all U.S. abortions today.

In response, Power to Decide Interim Co-CEO, Rachel Fey, released the following statement:

"With this ruling, abortion opponents are one step closer to their goal of ending access to abortion entirely. Once again, they're pushing junk science in the courts to move towards what the majority of people across the country do not want-a nationwide abortion ban.

Abortion opponents want to end the use of telemedicine for abortion because it's how more than a quarter of patients nationwide get abortion care today-and means that people can safely get the care they need without having to travel long distances to clinics.

When telemedicine is restricted, rural communities, people with low-incomes, and people of color suffer the most-and that is on top of the barriers they already face in the post-Dobbs landscape.

We urge the Supreme Court to block this reckless decision. The science, the polls, and the people are clear-abortion is healthcare and everyone deserves access.
