City Attorney Wes Duncan Announces Domestic Battery Conviction


The Sparks City Attorney's Office has announced that its prosecutor secured a conviction for Domestic Battery against Brian Foster, stemming from an incident that occurred on March 31, 2025.

On Monday morning, March 31st, 2025, Sparks Police Dispatch received a 9-1-1 call reporting a domestic disturbance involving her partner, Brian FOSTER, . She remained on the 9-1-1 line while officers responded. Sparks Police Dispatch could hear both of them arguing in the background.

Officers approached the front door and could hear a male and female arguing. The front door to the apartment was open, and the victim was inside with her two daughters, who were sitting on the couch. Her daughters were 13 and 11 years old. In the kitchen was FOSTER, who was with his 11-year-old son. FOSTER and the victim were arguing with each other as well as telling their children, "Tell the officers what you saw."

The victim was frantic and emotional while speaking, telling officers that an incident like this had not happened to her before. She explained she and FOSTER had been dating and living together for the past one and a half years. About a week ago, the victim had called FOSTER by her ex-husband's name accidentally, and FOSTER had become upset. FOSTER brought up her mistake the night before after getting intoxicated. A verbal argument started in the kitchen around 1:30 a.m. She attempted to distance herself from FOSTER, but he followed her from the kitchen to the bedroom and then to the living room, continuing the argument.

The altercation became physical when she was pushed by FOSTER in the living room. Then FOSTER pulled her hair, yanking her backwards towards him. She said she fell to the couch and was again grabbed by the hair, where he took a nearby latched tin-box and struck her on the back of the head with the box. The victim's daughter entered the room and was a witness to the altercation.
Additionally, the victim's phone was audio recording during this altercation.

The victim's 13-year-old daughter stated she witnessed FOSTER grabbing her mom by the back of her head while the victim was facing away from him. The minor child said she observed FOSTER strike her mom with his free hand to the face/side of head, causing her head to recoil away from the hit.

Probable cause was determined to arrest FOSTER for misdemeanor Domestic Battery, first offense, and Domestic Battery in the Presence of a Child. The officers ensured the victim was provided a Sparks Police Victim Services Pamphlet and explained the resources available to her, including how to obtain a protection order.

On January 14, 2026, Senior Assistant City Attorney Ana Swanson represented the City of Sparks and secured a conviction for Domestic Battery, first offense, against the Defendant.

"Prosecuting crimes of domestic violence continues to be top priority for the Sparks City Attorney's Office," said Sparks City Attorney Wes Duncan. "Domestic violence will not be tolerated, and my office will use all of its resources to prosecute and deter this behavior in our community."

As a result of the conviction, a Sparks Municipal Court Judge rendered the following sentence:
Mr. Foster will serve the maximum term of 90 days in the Washoe County Jail suspended for one year, on the conditions that he be placed on formal probation with the court to include regular testing for drugs and alcohol, spend 2 active days in jail, complete 48 hours of community service, pay a $200 fine plus administrative assessments, pay a $35 domestic violence fee, complete 26 weeks of domestic violence classes, attend an 8-hour class on the effects of violence in the home, and that he obey all laws. Foster was also ordered to surrender all firearms and restrict any future possession of firearms.
