WASHINGTON - Airports Council International - North America (ACI-NA), the trade association representing commercial service airports in the United States and Canada, issued the following statement ahead of the U.S. House of Representatives' vote on passage of H.R. 7613, the Airspace Location and Enhanced Risk Transparency (ALERT) Act of 2026, including Section 105.
"As the House considers the ALERT Act, we remain deeply disappointed by the inclusion of Section 105, the anti-airport provision that will undermine safety investigations and disrupt the funding framework that supports airport operations and safety-critical infrastructure nationwide. The National Transportation Safety Board's own analysis makes clear that this provision is unrelated to the agency's recent safety recommendations following last year's tragedy in Washington, D.C. Instead, it represents a blatant attempt by certain general aviation users to evade the fees they lawfully owe for access to and use of public airport facilities."
"Aviation safety must never be compromised. That is why we continue to strongly support the Senate's ROTOR Act, which more closely aligns with the NTSB's recommendations by strengthening ADS-B requirements for both civilian and military aircraft operating in and around airports. The ROTOR Act advances safer, more efficient airspace management while enhancing oversight, transparency, and coordination among the FAA, Department of Defense, airports, and other aviation stakeholders."
"As Congress continues its work to improve aviation safety, we urge lawmakers to ensure fair and consistent treatment of all airport users by removing Section 105 from the ALERT Act and adopting the stronger, safety-focused provisions included in the ROTOR Act."
