PRESS RELEASE BY THE MINISTRY FOR JUSTICE AND REFORM OF THE CONSTRUCTION SECTOR 'Artificial Intelligence and the Question of Imputability': Third Edition of the ELSA Union Debate

he Ministry for Justice and Reform of the Construction Sector once again hosted and supported the third edition of the Union Debate organised by ELSA Malta, held under the patronage of Professor Alexiei Dingli.

This year's chosen theme was 'Artificial Intelligence and the Question of Imputability'. The debate provided a platform through which students and professionals discussed this current topic in an analytical manner.

Minister for Justice and Reform of the Construction Sector Jonathan Attard stated that, "This debate is important to continue delving into the details of a field that is evolving every day. We must be wise enough to legislate where necessary, in a way that reflects both present and future needs."

The rapid pace at which technology is advancing, particularly generative artificial intelligence systems, is capable of producing highly realistic synthetic media.

"We must also keep in mind that, in the event of legislative amendments, these should not serve as a punishment for those who use technology. Rather, we must recognise the importance of artificial intelligence in today's technological landscape. Nevertheless, we are aware that, unfortunately, like any other technology, artificial intelligence can also be used maliciously, and therefore we must ensure that the law covers such situations and provides the necessary legal protection in these circumstances," added Minister Attard.

During his address, the Minister referred to two new offences introduced in the Criminal Code: cyberstalking and cyberbullying, noting that these have sent a clear message in today's digital world. "With the same determination, I am confident that we can address the subject of deepfakes. I look forward to launching a public consultation on this matter and working on legislative amendments that will further strengthen our criminal law," the Minister stated.

Minister Attard thanked ELSA for its passionate work in organising this activity, as well as for its ongoing efforts in supporting law students.

A significant number of students attended this activity, which continues to grow in popularity year after year. Minister Attard encouraged students to continue pursuing their studies, engaging in critical thinking, and participating in organisations that play an active role in Maltese society, including ELSA.

The Minister also acknowledged all the professionals who took part in this initiative and praised the academic synergy.

Dr Charles Mercieca, ⁠Dr Ian Gauci, Francesco Formosa, Emma Bugeja, Timmy Desira and Maya Briffa participated in the debate.
