Request for Public Comment re: Alabama Community Transition (ACT) Waiver Renewal Application

Pursuant to 42 CFR 441.304(f), the Centers for Medicare and Medicaid Services (CMS) requires states to obtain public input during the development of a waiver renewal. The Alabama Medicaid Agency (Medicaid) is issuing this 30-day public notice requesting public review and comment on the proposed renewal for the Alabama Community Transition (ACT) Waiver. The ACT Waiver is Alabama's method to enable individuals to live in their own homes or community settings in lieu of a nursing facility. The target population are individuals currently residing in an institution or individuals currently being served by one of Alabama's other HCBS Programs whose condition is such that their current program is no longer meeting their needs. Meaning, admission to an institution would be imminent if the ACT waiver were not an option to better serve their needs. The purpose of the renewal is to ensure the continuation of providing person-centered, high-quality care in the home and community, while maintaining cost-effectiveness and meeting federal requirements

Medicaid welcomes the public to submit comments on the proposed ACT Waiver renewal application within thirty (30) days from the date printed on this letter. A copy of the proposed renewal application can be accessed on www.medicaid.alabama.gov under the "LTC/Waivers" tab. Comments can be emailed to [email protected] or mailed to the provided address:

Comment letters must be postmarked by September 21, 2026, to be accepted. Upon request, a hard copy of this public notice and proposed waiver renewals can be made available for public review at Medicaid's Central Office and each District Office location. Please note that comments submitted in response to this notice are considered public documents and can be shared on the Alabama Medicaid website.
