Enforcement

MUR 8270

COMPLAINANT: FEC-Initiated
RESPONDENT: Citizens for Waters and David Gould, in his official capacity as treasurer (the Committee)
SUBJECT: In the normal course of exercising its supervisory responsibilities, the Commission initiated proceedings to determine whether there was reason to believe that in 2019 and 2020 the Committee 1) misstated $262,391 in receipts and $256,165 in disbursements), 2) accepted $19,000 in excessive contributions, and 3) made unlawful cash disbursements totaling $7,000.
DISPOSITION: The Commission entered into a conciliation agreement providing for the Committee to pay a civil penalty of $68,000 and to send its treasurer to a Commission-sponsored training program for political committees.

MUR 8301

COMPLAINANT: Tiffany Muller, End Citizens United
RESPONDENTS: X Corp. (X); Never Surrender, Inc. f/k/a Donald J. Trump for President 2024, Inc. and Bradley T. Crate, in his official capacity as treasurer (Trump Committee); and Donald J. Trump
SUBJECT: The complaint alleged that the social media platform X made, and 2024 Presidential candidate Donald J. Trump and the Trump Committee knowingly accepted, prohibited corporate contributions when X livestreamed an August 2024 conversation between Elon R. Musk, the owner of X, and Trump during which Musk expressly advocated Trump's election.
DISPOSITION: The Commission dismissed the allegations.

MUR 8316

COMPLAINANT: Jacob Thomas
RESPONDENTS: Terri Sewell for Congress and Lindsay Angerholzer, in her official capacity as treasurer (Sewell Committee); Microsoft Corporation Stakeholders Voluntary PAC - MSVPAC and Frank Cavaliere, in his official capacity as treasurer (MSVPAC); Google LLC NetPAC and Anne Wall, in her official capacity as treasurer (NetPAC); AT&T Inc. Employee Federal Political Action Committee and George B. Goeke, in his official capacity as treasurer (AT&T PAC); and Amazon.com Services LLC Separate Segregated Fund and Brian Huseman, in his official capacity as treasurer (Amazon PAC)
SUBJECT: The complaint alleged that the Sewell Committee violated the Act by inaccurately reporting a $25,000 disbursement to American Airlines for "polling." The complaint also alleged that the Sewell Committee violated the Federal Election Campaign Act of 1971, as amended (the Act), by making a total of $1,591.80 in contributions to four separate segregated funds: MSVPAC, NetPAC, AT&T PAC, and Amazon PAC. Finally, the complaint alleged that the Sewell Committee failed to include adequate disclaimers on several communications.
DISPOSITION: The Commission exercised its prosecutorial discretion and dismissed the complaint.

MUR 8320

COMPLAINANT: Montana Democratic Party
RESPONDENTS: Zinke for Congress and Paul Kilgore, in his official capacity as treasurer; and Ryan K. Zinke
SUBJECT: The complaint alleged that Zinke, a 2024 candidate for Montana's First Congressional District, and the Committee distributed a television advertisement that did not include an adequate disclaimer as required by the Act.
DISPOSITION: The Commission exercised its prosecutorial discretion and dismissed the complaint.

MUR 8333

COMPLAINANTS: Mark J. Block and Stephanie Holderfield
RESPONDENT: ActBlue and George Gilmer, in his official capacity as treasurer (ActBlue)
SUBJECT: The complaint alleged that ActBlue, a hybrid PAC with a non-contribution account that serves as a conduit for contributions to candidates and committees, violated the Act by allowing its platform to be used to effect contributions in the name of another. The complainant stated that someone used his alias without his permission to make a series of contributions that he stated he did not make.
DISPOSITION: The Commission exercised its prosecutorial discretion and dismissed the complaint.

ADRs 1197 and 1199

COMPLAINANTS: Mary McMillian; Tamara Fagin; and FEC-Initiated
RESPONDENT: Kumar for Congress and Gary Tasser, in official capacity as treasurer (the Committee)
SUBJECT: On the basis of two complaints and in the normal course of exercising its supervisory responsibilities, the Commission initiated proceedings to determine whether there was reason to believe the Committee 1) failed to disclose additional disbursements totaling $70,100 on its 2022 12-Day Pre-General Report, 2) failed to remedy 2024 general election contributions totaling $46,300, 3) misattributed $19,900 in contributions during the 2022 election cycle, and 4) whether the Committee misreported its election cycle-to-date receipts on its July 2023 Quarterly Report by $3,438. One of the complaints also alleged that Rishi Kumar, a 2024 candidate for California's 16th Congressional District, failed to file a Statement of Candidacy designating the Committee as his principal campaign committee for the 2023-2024 election cycle, despite meeting the statutory requirements as a candidate.
DISPOSITION: The Committee agreed to participate in an FEC training program and pay a civil penalty of $1,756.33, which is the amount of funds remaining in the Committee's bank account less a $1,700 outstanding refund check which shall be disgorged to the U.S. Treasury if not cashed within 90 days of issue.

Litigation

Berman v. FEC (Case No. 24-5289) On May 29, the U.S. Court of Appeals for the District of Columbia Circuit issued a Per Curiam Order granting the motion for summary affirmance.

CREW v. FEC (Case No. 22-0035) On May 28, the Commission filed a Response in Opposition to Plaintiff's Motion for an Order Declaring that Defendant has Failed to Conform to the Court's Judgment in the U.S. District Court for the District of Columbia.

McDonald v. FEC (Case No. 25-153) On May 27, the Commission filed a Reply in Support of its Motion to Dismiss in the U.S. District Court for the Northern District of Texas.

Public Disclosure

On May 29, the Office of the Inspector General released its Semiannual Report to Congress, covering October 1, 2024 to March 31, 2025.
