Take Five – May 28, 2026
On May 26, 2026, the Federal Motor Carrier Safety Administration issued a waiver for motor carriers and drivers transporting fertilizer products. The waiver applies to the hours-of-service limitations in 49 CFR 395.3 and the requirement for drivers to use an ELD to record the driver's duty status in 49 CFR 395.8(a)(1)(i) when transporting straight or blended fertilizer products for commercial farming and agricultural purposes. This waiver does not apply to the transportation of hazardous materials as defined in 49 CFR 383.5.
The waiver applies to 35 states, including Iowa and all neighboring states. The waiver ends on Aug. 26, 2026 at 11:59 p.m.
