TABC to hold Stakeholder Meeting to discuss draft rules on Oct. 8

Joined TABC by videoconference Thursday, Oct. 8, 10-11 a.m. CDT to discuss a draft new rule and a draft amendment to a marketing practices advisory.

Agenda

  1. Draft New Rule on SB 650: License Scanning by Retailers

    TABC drafted this rule to implement the Deshawn Jagwan Act [SB 650, 89th Leg., R.S. (2025)], which is codified in Section 109.61 of the Texas Alcoholic Beverage Code. The law generally requires all off-premises retailers and some on-premises retailers to inspect and electronically scan a purchaser's identification certificate prior to completing the sale of an alcoholic beverage. The law requires TABC to adopt rules implementing it no later than September 1, 2027.

  2. Draft Amendment to MPA027: Refunds, Credits, or Exchanges

    TABC published the current Marketing Practices Advisory 027: Refunds, Credits, or Exchanges (MPA027) in January 2009 to clarify statutory requirements and address common practices for distributors, wholesalers and wineries related to issuing refunds, credits and exchanges to retailers.

TABC's draft amendment to MPA027 does the following:

  1. Incorporates the brewer's self-distribution license;
  2. Updates the allowable timeline for effectuating retailer refunds, credits, and exchanges;
  3. Updates wording for clarity; and
  4. Updates statutory citations.

Rule Adoption Process

TABC intends to place the draft rule(s) on a future commission meeting agenda so TABC's commissioners can vote on whether to formally propose the rule(s) and publish them in the Texas Register for public comment. After publication in the Register and a 30-day formal comment period has lapsed, TABC's commissioners may vote on whether to adopt the proposed rule(s) at a subsequent commission meeting.

Advisory Adoption Process

TABC will publish the draft advisory in the September 25, 2026, issue of the Texas Register. TABC will receive comments on the advisory for up to 30 days following publication. After this comment period, TABC may update the draft advisory on its Advisories and Orders page. Notice will be provided through TABC's stakeholder email notifications.
