Illegal alien sentenced to prison for unlawful firearm possession

WICHITA, KAN. - An illegal alien from Mexico was sentenced to 15 months in prison for unlawfully having a firearm.

According to court documents, Eliaser Tolentino-Morales, 36, pleaded guilty to one count of possession of a firearm by an illegal alien.

In March 2026, Tolentino-Morales was riding in the front passenger seat of a jeep when he fired a gun into the air. Wichita police subsequently stopped the vehicle. After Tolentino-Morales exited the jeep, officers noticed a loaded pistol on the front passenger floorboard. Tolentino-Morales admitted to having the firearm.

"Possessing a firearm while unlawfully in the United States is a federal crime," said U.S. Attorney Ryan A. Kriegshauser. "By discharging a weapon from a moving vehicle, the defendant created a dangerous situation, and we are fortunate no one was injured."

The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) investigated the case.

Assistant U.S. Attorney Katie Andrusak prosecuted the case.
