Washington, D.C. - The following statement can be attributed to Small Business & Entrepreneurship Council (SBE Council) President & CEO Karen Kerrigan in response to the U.S. District Court's ruling against the Federal Trade Commission (FTC) in the Meta case:
"The FTC has lost yet another case, which was expected given the ideological and invented thought that drove former Chair Lina Khan's legal and regulatory activism."
"In this case, beyond concluding the obvious - that Meta does not have monopoly power in the market given the competitive and highly dynamic environment - the court's decision is important to America's startup ecosystem. This potentially disruptive FTC case sought to ultimately force the divestiture of acquisitions by Meta that it had previously approved, which served to create uncertainty for America's powerful startup ecosystem."
"Such instability undermines America's innovative entrepreneurs and small business owners who are building businesses and seeking M&A opportunities for capital and resources to bring their products and services to the broader marketplace. Reversing, in effect, previously approved acquisitions would have a significant dampening effect on productive M&A activity. This is bad for competition, innovation, and economic growth. Moreover, potential remedies against Meta could have impacted the affordability and seamless use of Meta's social media and social commerce tools that are driving sales and growth for small business users."
"Although the business community is pleased that the former FTC Chair's legal cases and regulatory proceedings continue to be rebuffed by the courts, Lina Khan's actions have come at great costs. Moving forward, the current FTC would be wise to pull the plug on these Biden-era cases and regulations that are not only wasting taxpayer dollars and getting tossed, but undermine President Trump's growth and innovation agenda."
