Public Hearing on proposed rules April 28

Join TABC staff by video conference to discuss rules proposed by the commission and published in the Texas Register for public comment.

After these proposed rules are published in the Texas Register and a 30-day formal comment period has lapsed, the rules will be eligible for adoption at a subsequent TABC commission meeting.

Meeting Agenda

Item 1. Summary of Proposed Amendment to Rule 41.12 (Compliance Reports)

ENGLISH: TABC proposes an amendment to 16 TAC §41.12, relating to Compliance Reporting by License and Permit Holders. Current §41.12(d) provides that TABC may issue a written warning to a permittee or licensee who fails to file a compliance report in a timely manner. The proposed amendment adds new subsection (e), which would permit TABC to issue such a warning without providing the permittee or licensee an opportunity for an administrative hearing.

SPANISH: TABC propone una enmienda al artículo 41.12 del Título 16 del Código Administrativo de Texas (TAC, por sus siglas en inglés), relacionado con los informes de cumplimiento por parte de titulares de permisos y licencias. El artículo 41.12(d) vigente establece que la TABC puede emitir una advertencia por escrito a un titular de permiso o licencia que no presente un informe de cumplimiento de manera oportuna. La enmienda propuesta añade un nuevo inciso (e), que permitiría a la TABC emitir dicha advertencia sin otorgar al titular de permiso o licencia la oportunidad de una audiencia administrativa.

Item 2. Summary of Proposed New Rule 35.7 (Consumable Hemp Products)

ENGLISH: TABC proposes new rule 16 TAC §35.7, relating to Consumption of Consumable Hemp Products. The proposed rule prohibits a permittee or licensee from authorizing or allowing any person to consume a consumable hemp product (CHP) on any permitted or licensed premises where the consumption of alcoholic beverages is generally prohibited.

SPANISH: TABC propone nueva regla 16 TAC §35.7, relacionada con el consumo de productos de cáñamo consumibles. La regla propuesta prohíbe que un titular de permiso o licencia autorice o permita que cualquier persona consuma un producto de cáñamo consumible (CHP, por sus siglas en inglés) en cualquier establecimiento con permiso o licencia donde generalmente este prohibido el consumo de bebidas alcohólicas.

Oral Comments: The public may provide TABC with oral comments about the proposed rules during the public hearing. This hearing is the only forum to make oral comments under Government Code Section 2001.029. There will also be an opportunity to ask questions and make informal comments that do not become part of the public record.

Written Comments: The public may provide written comments about the proposed rules, which TABC will consider if received by 5:00 p.m. Central time on May 11, 2026.
