Pursuant to Texas Rule of Appellate Procedure 56.3, the Court severs the claims between petitioners Matrix Petroleum, LLC, Matrix Petroleum Holdings LLC, JAR Resources Holdings L.P., TMRX Petroleum, LLC (collectively, Matrix), petitioner OGE, LLC, and respondent Repsol Oil and Gas USA, LLC from case no. 24-0810 into case no. 24-0930, styled Matrix Petroleum, LLC, Matrix Petroleum Holdings LLC, JAR Resources Holdings L.P., TMRX Petroleum, LLC, and OGE, LLC v. Repsol Oil and Gas USA, LLC. Without considering the merits, the Court grants the petition for review in case no. 24-0930 and vacates the court of appeals' judgment as to the claims severed into that case, except that the court of appeals' judgment is not vacated as to Statoil Texas Onshore Properties, LLC and Statoil Pipelines, LLC's claim for attorney's fees from Matrix and the court of appeals' declaration that Matrix and OGE, LLC are subject to a non-consent penalty pursuant to Section 8 of the joint operating agreement as to the 2016 Wells. The case is remanded to the trial court for rendition of a judgment in accordance with the parties' agreement. The remainder of the appeal in case no. 24-0810, restyled Statoil Texas Onshore Properties, LLC, and Statoil Pipelines, LLC v. Matrix Petroleum, LLC, Matrix Petroleum Holdings LLC, JAR Resources Holdings L.P., TMRX Petroleum, LLC, and OGE, LLCremains pending before this Court.
