Energy powders for inhalation have recently appeared on the EU market. They are promoted as lifestyle products providing an instant energy or focus boost and are consumed through the nose. They are aggressively marketed online and on social media, often mimicking illegal drug use, while avoiding clear classification as food, food supplements, medicinal products, tobacco-related products or medical devices.

This raises serious concerns as regards public health and consumer protection, particularly because of the lack of independent scientific assessment of inhaled stimulant substances and the clear appeal of these products to young people and minors.

Against this background:

  • 1.How does the Commission assess the legal status of 'energy powders for inhalation' under current EU law, and does it consider existing EU legislation sufficient to protect consumers, especially minors?
  • 2.Does the Commission intend to request or mandate a scientific risk assessment, by the European Food Safety Authority or another relevant EU body, on the effects of inhaled stimulant products on health, especially for children and adolescents?
  • 3.Does the Commission consider that the marketing and presentation of these products circumvent existing EU rules on food supplements, health claims and the protection of minors, and what enforcement or legislative action does it intend to take in response?
