City Attorney Wes Duncan Announces Domestic Battery 1st Conviction


The Sparks City Attorney's Office has announced that its prosecutor secured a conviction against Eduardo RODARTE, for Domestic Battery 1st, stemming from an incident that occurred on December 9, 2025.
On December 9, 2025, law enforcement was dispatched to a physical altercation between the reporting party and Eduardo RODARTE. As the officer arrived, the victim was leaving the apartment with their two minor children. All three individuals were visibly scared, and the victim's nose was bleeding. She was going to take her children to her mother's residence.

The victim shared the following with the officer while REMSA arrived to provide medical attention. The victim explained that RODARTE left the residence to walk the dog and was gone for longer than expected, so the victim assumed he was out drinking due to RODARTE having an extensive history of alcohol abuse. The victim was in her daughter's room, lying in bed with them, when RODARTE returned home. She said that RODARTE was very angry because he was under the impression she was cheating on him. RODARTE grabbed her while she was lying on the bed and dragged her off the bed and around the room. RODARTE threw her phone across the room so she could not access it. Eventually, she was able to get her phone and call 911. This enraged RODARTE, and he punched her on the side of the head and then punched her again on the left side of the face around her nose and left eye. The victim stated she felt "woozy" when he punched her in the face. She had a significant amount of blood covering the majority of both of her hands and face from her bloody nose, and was continuing to bleed while the officer spoke to her.

Several officers attempted to call RODARTE to interview him but were unable to contact him at the residence. There was a visible light on in the residence, but no one answered the door. As a result, a warrant was requested and issued by the Sparks Municipal Court on January 13. 2026. Ultimately, he was arrested on this warrant on April 15, 2026.

On June 8, 2026, a Senior Assistant City Attorney represented the City of Sparks and secured a conviction for Domestic Battery, first offense, against the Defendant.

"The Sparks City Attorney's Office will continue to aggressively prosecute crimes of domestic violence and stand up to defendants who use physical violence against their partners, especially in the presence of children," said Sparks City Attorney Wes Duncan.

As a result of the conviction, a Sparks Municipal Court Judge rendered the following sentence:
Mr. Rodarte will serve the maximum term of 30 days in the Washoe County Jail suspended on the conditions that he abstain from drugs and alcohol, spend 55 active days in jail, complete 48 hours of community service, pay a $200 fine plus administrative assessments, pay a $35 domestic violence fee, complete 26 weeks of domestic violence classes, complete he effects of violence in the home class, and that he obey all laws. Defendant was also ordered to surrender all firearms in his possession.
