Supreme Court Invites Public Comment on Potential Rule Changes

February 11, 2026

The California Supreme Court welcomes public comment on possible amendments to rules 8.1115 and 8.1125 of the California Rules of Court. As further described in the court's Invitation to Comment, the potential amendments would affect the citation of unpublished appellate opinions in certain court filings, the citation of published Court of Appeal opinions in cases in which the Supreme Court has granted review, and service requirements for requests for depublication. The court is considering these changes pursuant to its constitutional and statutory authority over the publication and citation of opinions filed by California courts.

All comments must be emailed to the Supreme Court at [email protected] no later than March 25, 2026. The court will take any comments received into consideration in evaluating possible amendments to these rules.
