ICE, Harris County Sheriff’s Office arrest multiple criminal illegal aliens accused of repeatedly raping 12-year-old child smuggled into US during Obama administration

HOUSTON - ICE HSI Houston and the Harris County Sheriff's Office arrested two men who are accused of repeatedly raping a 12-year-old-girl.

Felix Bustillo Diaz, a 49-year-old criminal illegal alien from Honduras, and Jose Gerber-Rivera, a 45-year-old Salvadoran national, are accused of repeatedly raping Bustillo's 12-year-old grandniece who was illegally smuggled into the U.S. by her Honduran mother in 2014 during the Obama administration. The child was left alone with Bustillo as her sponsor.

In 2024, despite being an illegal alien with a criminal conviction on his record, Bustillo was granted Temporary Protected Status (TPS) by the Biden administration. His TPS has since been terminated.

At one point, Bustillo's victim managed to escape from Bustillo with the help of Brenda Garcia, 38, and Tania Garcia, 37, both Houston-area residents, who falsely told her they were rescuing her from being sexually abused only to allegedly zip-tie, beat, torture and malnourish the minor and force her to perform manual labor for them. HSI Houston and the Montgomery County Sheriff's Office arrested both women on Oct. 3 for felony injury to a child, unlawful restraint, and invasive visual recording.

Rivera was taken into custody with assistance from the Montgomery County Constables Office in the Woodlands, Texas, Nov. 4, and Bustillo, who has been detained by ICE for immigration violations at the Montgomery Processing Center, was transferred into HCSO custody Nov. 5.

"The conduct uncovered in this investigation was both disturbing and inexcusable," said HSI Houston Special Agent in Charge Chad Plantz. "Our agents and partners worked tirelessly to ensure these individuals are brought to justice and held fully accountable for their crimes. HSI puts the safety and security of the victims as our highest priority."

"Arresting violent people who seek to prey on our most vulnerable residents is our top priority, and the allegations in this case are especially disturbing," said HCSO Sheriff Ed Gonzalez.

"The details of this investigation are deeply disturbing and represent some of the most evil criminal behavior in our society," said Montgomery County Sheriff Wesley Doolittle. "While the child is now safe, our mission is far from over. We will continue to work tirelessly with our law enforcement partners to uncover all details of this investigation and ensure that justice is served."

This remains an active and ongoing criminal investigation. To protect the child's privacy and preserve the integrity of the case, no further details will be released at this time. Once more information becomes available, an update will be provided.

Members of the public who suspect they have encountered a minor who is being sexually exploited are urged to report it to either their local law enforcement or to HSI by calling our Tipline at 1-866-DHS-2423. All information received via the tipline will be reviewed by appropriate personnel and referred to HSI field offices for potential investigation.
