WASHINGTON - Today Congressman Gabe Evans (CO-08) and Congressman Nick Langworthy (NY-23) sent a letter to Howard Lutnick, the Secretary of Commerce, regarding newly enacted state-level regulations on artificial intelligence (AI) and their impact on American innovation, and competitiveness.
In the letter, the Members highlight concerns with Colorado's SB 205 and New York's RAISE Act, warning that a growing patchwork of conflicting state AI laws risks undermining U.S. leadership in one of the most transformative technologies of our generation.

If we care about American jobs, national security and staying ahead of our foreign adversaries, we need a smart, consistent national approach that keeps innovation here at home" - Congressman Gabe Evans
"Artificial intelligence is already transforming economies across the globe, and it's not going away. The question is not whether AI will shape the future, it's who will set the standards that govern its development and use. The United States is best positioned to establish strong, innovation-driven standards that protect consumers, safeguard children, and promote economic growth. We cannot allow a patchwork of burdensome state regulations to weaken our competitive edge, nor can we afford to let Communist China dictate the global rules of the road. Creating uniform federal standards are essential to protecting our economy, our values, and our national security." - Congressman Nick Langworthy
In the letter, Reps. Evans and Langworthy note the rapid expansion of state-level AI regulation and urge the Department to carefully evaluate its impact on interstate commerce and constitutional protections.
An excerpt from the letter reads:
"In 2025, states enacted 145 AI-related laws, an almost 50 percent increase over the previous year.15 While the laws specified above are not a comprehensive list, we nonetheless urge you to include them in the Department's report, as they exemplify the conflicting, burdensome, and imprudent state regulations that the President's EO seeks to address. We stand ready to support the Administration's goal of establishing a coherent, pro-innovation national AI policy framework that promotes American innovation and competitiveness and ensures children and communities remain safeguarded."
