Concord, NH - Attorney General John M. Formella announced today that the Merrimack County Superior Court has issued a preliminary injunction requiring Granite Personal Training, Inc, doing business as Redwood Personal Training (Redwood), to immediately comply with New Hampshire's Health Club Statute (RSA 358-I).
The Court's order comes in response to a lawsuit filed by the New Hampshire Department of Justice, alleging that Redwood violated state laws through its illegal process for customers cancelling prepaid health club contracts.
Under the Court's order, for contracts valued at more than $1,000, Redwood must:
• Honor cancellation requests from customers on the date notice is provided.
• Stop charging customers any ongoing monthly fees upon cancellation.
• Not charge early termination fees to cancel contracts.
• Provide refunds for the unused portion of services when requested by eligible customers.
These requirements apply immediately and will remain in effect unless or until the court issues a new order.
The Department of Justice is continuing to pursue the case, seeking permanent protections for consumers, restitution for affected individuals, and civil penalties.
The State is represented by Senior Assistant Attorneys General Alexandra Sosnowski and Brandon Garod of the Department of Justice's Consumer Protection and Antitrust Bureau.
