James Tetreault Arrested for Vital Records Fraud and Notarial Misconduct

Concord, NH - Attorney General John M. Formella announces that James Tetreault (age 60) of Winchester, New Hampshire, has been arrested and charged with one class B felony count of Vital Records Fraud, contrary to RSA 5-C:14 & RSA 5-C:49, and one class A misdemeanor count of Notarial Misconduct, contrary to RSA 455:16, I(b) & RSA 455:16, II.

Mr. Tetreault is expected to be arraigned at the Eighth Circuit Court, Keene District Division, at 10:00am on May 7, 2025.

The charges allege that Mr. Tetreault, a New Hampshire justice of the peace, knowingly certified and signed a marriage license stating that he had performed the marriage when he had not performed that marriage.

Mr. Tetreault currently serves as the Town Clerk/Tax Collector at the Town of Winchester, New Hampshire.

Class B Felony charges may be penalized by 3 ½ - 7 years in the New Hampshire State Prison and a fine of up to $4,000.00. Class A misdemeanor charges may be penalized with up to 1 year in the House of Corrections and a fine of up to $2,000. The charges and allegations against Mr. Tetreault are merely accusations. Mr. Tetreault is presumed innocent unless and until proven guilty.

This case is being prosecuted by Assistant Attorneys General Matthew Conley and Brendan O'Donnell of the Election Law Unit. The investigation into this matter was conducted by New Hampshire Department of Justice Investigator Jennifer DiGeorge.
