WASHINGTON-On Wednesday, United States Senator Bill Hagerty (R-TN) submitted a formal complaint to the Tennessee Supreme Court's Board of Professional Responsibility, calling for the disbarment of former special counsel Jack Smith.
The complaint centers on Smith's unconstitutional acquisition of phone records associated with Hagerty and other members of Congress as part of the Arctic Frost investigation. Hagerty alleges that Smith withheld critical information from a federal court in violation of the ethics rules applicable to Tennessee lawyers, which includes Smith. Because Smith withheld that information, the court issued a nondisclosure order preventing Hagerty and his colleagues from challenging Smith's unconstitutional collection of their records.
The complaint was filed following Smith's appearance before the Senate Judiciary Committee on Tuesday, which revealed that Smith obtained confidential donor information of thousands of Americans, including many Tennesseans, and that Smith's team violated filter protocols put in place to comply with the Constitution.
"Jack Smith's lack of candor before a federal tribunal directly resulted in injury to the United States Congress," said Hagerty. "The Board should investigate and pursue the most serious remedy possible-disbarment-in light of the gravity of Smith's intentional conduct."
