ASPPH Submits Comments on Proposed IRS Rule, Encourages Member Engagement

October 28, 2026

ASPPH has submitted a comment letter expressing serious concerns about the Internal Revenue Service's (IRS) proposed rule on racial nondiscrimination in private, nonprofit higher education institutions. The letter highlights potential consequences for academic public health research, education, and community partnerships and urges the IRS to withdraw or substantially revise the proposal.

While ASPPH remains firmly committed to preventing unlawful discrimination, the proposed rule raises concerns about the potential loss of tax-exempt status for institutions and the implications for essential public health activities.

ASPPH strongly encourages member institutions to work with their government relations teams to submit their own comments, using ASPPH's letter as a guide. Institutional perspectives and examples can help demonstrate the proposal's potential consequences for academic public health.

In its October 23 letter, ASPPH emphasizes that the proposal's broad language could create uncertainty for institutions conducting research on health disparities, engaging with underserved communities, and participating in federally supported public health initiatives.

The letter also calls for clearer standards, appropriate procedural protections, and assurances that legitimate public health research, instruction, and community partnerships will not be considered discriminatory.

Tax-exempt status plays a critical role in supporting scholarships, research centers, workforce development, and community programs that advance public health nationwide. ASPPH is concerned that the proposed rule could jeopardize these activities and weaken institutions' ability to serve their communities.
