Notice of Renewal Decision: ADL 106062 - Rocky Point Resort Dock

Public Notice: Lease ADL 106062 Renewal

Per 38.05.070(e), the Department of Natural Resources (DNR); Division of Mining, Land, and Water (DMLW); Southeast Regional Office (SERO) has made a decision to renew an existing lease issued to Fishhawk Charters doing business as Rocky Point Resort (applicant) for an additional 25-year term. This lease will continue to support a dock used for access by the applicant, guests and lodge employees of Rocky Point Resort at Rock Point in Petersburg, Alaska, within the N/W ¼ of Section 14, Township 60 South, Range 79 East, Copper River Meridian.

An eligible person affected by this decision may appeal to the DNR Commissioner per AS 44.37.011 and 11 AAC 02. Any appeal must be received by the Commissioner's Office within twenty (20) calendar days after issuance of the decision under 11 AAC 02.040. Pursuant to Alaska's Administrative Procedure Act and AS 44.62.520(a), this decision becomes effective when: (1) no eligible party timely appeals and the decision becomes effective the day after the regulatory-required appeal period under 11 AAC 02.040(a); or (2) after the Commissioner issues a decision on appeal. The Commissioner's decision on appeal, other than a remand decision, is the final administrative order and decision of the department. An eligible person must first appeal to the Commissioner before seeking relief in superior court. The Alaska State Courts establish its own rules for timely appealing final administrative orders and decisions of the department.

DNR reserves the right to waive technical defects in this publication.
