BOSTON - Today, a federal district court issued a preliminary injunction, blocking the provision in the reconciliation law that attempts to unconstitutionally "defund" Planned Parenthood but only as to some Planned Parenthood members. In the ruling, the court made clear that the law is likely unconstitutional and recognized the immediate and dire harms it would impose on people who use Medicaid and on Planned Parenthood.
The partial relief has been granted as to Planned Parenthood members who do not independently meet the "defund" provision's definition of a "prohibited entity," that is, who cannot provide abortions because of state abortion bans, or who received less than $800,000 in Medicaid reimbursements in 2023. However, at least for now, the court appears to stop short of granting a preliminary injunction as to all members, as would be required to guarantee continued access to care for Medicaid patients across the country. For those members not covered by this preliminary injunction, the "defund" provision will go into effect again - risking chaos, confusion, and harm for patients who could now be turned away when seeking lifesaving reproductive health care from their trusted provider at a Planned Parenthood health center.
Joint statement from Planned Parenthood Federation of America, Planned Parenthood League of Massachusetts, and Planned Parenthood Association of Utah:
"This isn't over. While we're grateful that the court recognized the harm caused by this law, we're disappointed that not all members were granted the necessary relief today. Patients across the country should be able to go to their trusted Planned Parenthood provider for birth control, cancer screenings, and STI testing and treatment. This is about patients and their right to get care - no matter their insurance. The court has not yet ruled on whether it will grant preliminary injunctive relief to other members. We remain hopeful that the court will grant this relief. There will be nothing short of a public health crisis if Planned Parenthood members are allowed to be 'defunded.'"
The Trump administration's attack on Planned Parenthood is designed to sow chaos and confusion. PPFA and its members will continue to fight this unconstitutional, targeted attack on patients' health care and rights - and that means things might change rapidly. This case was brought by Planned Parenthood Federation of America, Planned Parenthood League of Massachusetts, and Planned Parenthood Association of Utah after President Trump signed the law, which stops patients from using their Medicaid health insurance at Planned Parenthood health centers nationwide.
