ALJ Decision in Metro Ports, d/b/a Southeast Crescent Shipping, OSHRC Docket No. 23-1554, Becomes a Final Order of the Commission.

The Respondent, Metro Ports (Metro), is a California-based stevedoring company that operates marine terminals on the nation's coasts, including a marine terminal at the Port of Wilmington in North Carolina. (See Ex. C-7, Bates pagination 0188-0194; T. 156, 160). In July 2023, the U.S. Occupational Safety and Health Administration (OSHA) received a complaint about Metro's handling of hazardous cargo that was being shipped in containers known as "super sacks," which have the technical name flexible intermediate bulk containers (FIBCs). An OSHA inspection and investigation ensued.
