Determination Made on Use of Force in Officer-Involved Shooting in Dover on April 13, 2025

Concord, NH - Attorney General John M. Formella announces that the Attorney General's Office has made a determination as to the lawfulness of the police officer shooting of Moriah Infinjer (age 28) in Dover, New Hampshire on the morning of April 13, 2025.

At about 1:00 a.m. on April 13, Trooper Colin Burgess of the New Hampshire State Police effectuated a traffic stop of a car being driven by Ms. Infinjer on the Spaulding Turnpike in Dover. During that incident, Trooper Burgess fired several shots at Ms. Infinjer, striking her once in the shoulder.

Although Ms. Infinjer survived, Trooper Burgess's shooting of her constitutes the use of deadly force under the law. The Attorney General's Office has conducted a full investigation in order to determine whether that use of deadly force against Ms. Infinjer was legally justified. After a review of evidence gathered during the course of the investigation, the Attorney General has determined that Trooper Burgess's shooting of Moriah Infinjer was a legally justified use of deadly force.

The Strafford County Attorney's Office has brought criminal charges against Moriah Infinjer in connection with events relating to her April 13th encounter with Trooper Burgess. Those charges are pending. As a result, the Attorney General's Office is unable to release further information about its investigation at this time. N.H. Rules of Professional Conduct 3.6(a) ("A lawyer who . . . has participated in the investigation . . . of a matter shall not make an extrajudicial statement that the lawyer knows or reasonably should know will be disseminated by means of public communication and will have a substantial likelihood of materially prejudicing an adjudicative proceeding in the matter."). However, when the current legal proceedings against Ms. Infinjer have concluded, the Attorney General's Office will issue its full report on the investigation into Trooper Burgess's use of deadly force, with the associated findings and reasoning behind the determination made.
