Proposed Relinquishment of State Entitlement Lands

Comment Period Ends 3:30 PM, January 30, 2025

The Department of Natural Resources (DNR) is proposing to relinquish the State's entitlement land selection of both the surface and subsurface estate on the downstream end of Kalka Island in the Yukon River, located in Sections 14, 23 and 24, Township 11 North, Range 12 West, Fairbanks Meridian, Alaska, containing approximately 66.70 acres. The allotment is tagged with a BLM site tag and orange triangular survey marker at Lat. 65° 46' 1.11" N., Long. -149° 59' 22.81" W. A location map is available with this notice. The lands are not currently owned by the State, they are under Federal management and ownership. The purpose of relinquishment is to facilitate conveyance of a substitute Native Allotment serialized as FF-17131.

Alaska Statute (AS) 38.05.020(b)(8) allows for relinquishment of land or an interest in land to the federal government if the land is described in an amended application for an allotment under 43 U.S.C. 1617(c), if relinquishment is in the best interests of the state. AS 38.05.035 allows for disposals of interests in state lands, and AS 38.05.945 provides procedures for notice of those disposals.

The subject land is a substitute allotment parcel being settled in accordance with the Stipulated Procedures for Implementation of Order approved by the Court to implement the decision in Ethel Aguilar v. United States of America, 474 F. Supp. 840 (D. Alaska 1979), hereinafter referred to as Aguilar. Allotment F-17131 was originally filed under the 1906 Native Allotment Act. The original allotment lands were conveyed to the State in error and have been found unsuitable for reconveyance to the applicant. The applicant has selected the lands on Kalka Island as a substitute parcel in accordance with Aguilar.

The deadline for public comment is 3:30 PM, Thursday, January 30, 2025.Only persons from whom the Department of Natural Resources receives timely, written comment during the identified comment period will be eligible to file an appeal of the decision.
