D.A. Bragg Announces Indictment In Subway Shoving Of 72-Year-Old Man

Manhattan District Attorney Alvin L. Bragg, Jr., today announced the indictment of FRANCISCO GARCIA, 41, for allegedly shoving a 72-year-old man onto the subway tracks at the Rockefeller Center subway station in August 2026. GARCIA is charged in a New York State Supreme Court indictment with one count of Attempted Assault in the First Degree and two counts of Assault in the Second Degree. [1]

"A 72-year-old man was standing on the subway platform when Francisco Garcia allegedly shoved him onto the tracks in a terrifying unprovoked attack," said District Attorney Bragg. "My thoughts are with the victim as he continues to heal from this assault. Attacks on straphangers have no place in our bustling transit system, and we will continue to collaborate with our law enforcement partners to keep the subways safe."

As alleged in court documents and statements made on the record in court, at approximately 3:53 a.m. on August 19, 2026, GARCIA shoved a 72-year-old-man onto the subway tracks at the Rockefeller Center subway station without provocation. The victim was treated at Mount Sinai West and Mount Sinai Morningside hospitals for a fractured collarbone and fractured ribs. GARCIA attempted to flee the scene by boarding another train before being apprehended by the NYPD.

Assistant D.A. David Olivar (Trial Bureau 30) is handling the prosecution of this case with Assistant D.A. Olivia Tucker (Trial Bureau 30) under the supervision of Assistant D.A. Erin Tierney (Chief of Trial Bureau 30) and Executive Assistant D.A. Lisa DelPizzo (Chief of the Trial Division).

D.A. Bragg thanked the NYPD, particularly Officer Xavier Bolton of Transit Division District 1.
