EPA Orders Med Solutions to Stop Selling and Distributing Certain Ultraviolet Light-Based Antimicrobial Products

ATLANTA, GA(September 19, 2024) - The U.S. Environmental Protection Agency (EPA) has issued a Stop Sale, Use, or Removal Order (SSURO) to Med Solutions LLC (Med Solutions), a company based in Cumming, Georgia, relating to certain ultraviolet light-based antimicrobial devices. These devices were marketed under a variety of product names, including UV Medico, Aquisense PearlAqua, Fresh-Aire UV Air Handler System, TruSens, UV Angel, Violux Luma Pro+, and Kepri. EPA investigations found that the company was marketing, selling, and distributing these products in ways that were inconsistent with the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and EPA's regulations.

Based on EPA's investigations, each of these devices is misbranded pursuant to federal law, as their labeling contains false or misleading statements concerning the effectiveness of the products as devices. More specifically, the company's marketing materials made broad, unsupported, and unqualified public health claims concerning the efficacy of each device, including claims that the devices were effective against "bacteria," "viruses," "pathogens," "germs", "infections," and "mold" without identifying the specific micro-organisms against which the products have been shown to be effective. In addition, some of the devices were further misbranded with labeling claiming that they are "safe for use." .

As a result, EPA issued a SSURO that required Med Solutions to immediately stop selling and distributing these products. The SSURO will remain in effect unless revoked, terminated, suspended or modified in writing by EPA.

"The EPA prohibits companies from including false or misleading claims on FIFRA-regulated products. False or misleading claims can provide a false sense of security to consumers. Companies are responsible for the claims they make about their FIFRA-regulated products," said Jeaneanne Gettle, acting EPA Regional Administrator. "EPA is committed to holding companies accountable for not adhering to federal environmental laws."
