Albany County District Attorney Lee C. Kindlon announced today that a 45-year-old man who broke into a man's apartment, donned his clothes, ate his food and then tried to claim it was his residence has admitted his guilt in court.
Kenneth Radley pleaded guilty to Burglary in the Second Degree in front of the Honorable William Little for an Aug. 6, 2024, incident at 99 South Lake Ave.
It was just after 5 p.m. that day when a male victim came home from work to find his apartment door ajar and the residence ransacked. The man entered the apartment and was confronted by a stranger dressed in his own black tank top, grey sweatpants and white Adidas sneakers. The man had also eaten food from his refrigerator and taken a bath.
The victim ordered Radley out, but he yelled that it was his apartment and started pushing the victim. An altercation ensued and the victim was able to pin Radley down on the floor until Albany Police arrived.
APD later found out that Radley had attempted to burglarize another apartment in the same building earlier that day.
He will be sentenced on July 30 and faces seven to nine years in state prison followed by five years of post-release supervision.
The case is being prosecuted by Assistant District Attorney Stephen Lydon of the Major Crimes Unit.
