Representative Roy reintroduces the Border Safety and Security Act

WASHINGTON- Today, Representative Roy reintroduced the Border Safety and Security Act, a bill providing a framework for the Trump Administration and future administrations to secure our southern border and stop the release of illegal aliens into our communities. Americans have suffered for four years under the worst border security crisis in recent American history.
"The American people have endured the worst border crisis in recent history for the past four years due to the Biden Administration's willful refusal to secure the border," Congressman Roy said at the introduction. "Millions of illegal aliens are now in the country and we will feel the impacts of this disaster for years to come.

"It is imperative Congress enact permanent policies that empower President Trump and future presidents to secure the border. The Border Safety and Security Act does just that."

The Border Safety and Security Actwould:

  • Provide the Homeland Security Secretary with authority to turn away aliens who do not have valid entry documents if the Secretary deems it necessary to obtain operational control of the border.
  • Require the Secretary to use this "turn away" authority when an alien cannot be:
    • Detained through the pendency of an asylum claim, or
    • Placed in a program similar to the previous administration's Migrant Protection Protocols (Remain-in-Mexico).
  • Allow state attorneys general to enforce the bill through suit for injunctive relief.

This bill is cosponsored by Reps. Beth Van Duyne (TX-24), Pete Stauber (MN-8), Clay Higgins (LA-3), Dan Crenshaw (TX-2), Michael Cloud (TX-27), Eli Crane (AZ-2), Scott Perry (PA-10), Randy Weber (TX-14), Monica De La Cruz (TX-15), Rich McCormick (GA-6), Harriet Hageman (WY-AL), Roger Williams (TX-25), Wesley Hunt (TX-38), Mike Collins (GA-10), Jake Ellzey (TX-10), Trent Kelly (MS-1), Ben Cline (VA-6), Jeff Van Drew (NJ-2), Scott Fitzgerald (WI-5), Andy Biggs (AZ-5), Lauren Boebert (CO-4), Brett Gutherie (KY-2), Andy Harris (MD-1), Keith Self (TX-3), Brian Babin (TX-36), Russ Fulcher (ID-1), Andy Ogles (TN-5), Tom McClintock (CA-5), Ryan Zinke (MT-1), Darrell Issa (CA-48), Ralph Norman (SC-5), Pete Session (TX-17), Mary Miller (IL-15), Morgan Luttrell (TX-8), Pat Fallon (TX-4), Byron Donalds (FL-19), Josh Brecheen (OK-2), Barry Moore (AL-2), and Anna Paulina Luna (FL-13).

Comments from supporting organizations:

"The Immigration Accountability Project is proud to endorse Congressman Chip Roy's Border Safety and Security Act of 2025. This bill would finally put teeth in the law's requirement that illegal aliens be detained, returned, or denied entry. By giving the Secretary of the Department of Homeland Security an explicit mandate to deny entry to illegal aliens who cannot be detained or returned, the bill puts a clear end to the catch-and-release policies that have devastated American communities. Equally important is the bill's grant of standing to state Attorneys General to sue the Secretary for failure to enforce the law. The 119th Congress should pass this legislation expeditiously."

"Nearly eleven million illegal aliens flooded over our borders in just four years - beyond crisis levels. Now more than ever, the American people deserve real solutions to put a stop to the tide of illegal border crossers and restore order. The Border Safety and Security Act is a critical step to establishing operational control of our borders and ensuring that future administrations cannot again circumvent the law to usher in mass illegal immigration. FAIR applauds Congressman Roy for taking the lead to end the border crisis and keep Americans safe."
