(WASHINGTON, D.C.) - Today, the Supreme Court issued a temporary order allowing continued mail and pharmacy dispensing of mifepristone, pausing a lower court ruling in Louisiana v. Food and Drug Administration (FDA) that would have imposed medically unnecessary in-person dispensing requirements. The temporary stay will expire at 5 p.m. ET on May 11th.
While the Court's action maintains telehealth access to mifepristone for a week, it does not resolve the broader legal challenge to medication abortion or the growing effort to undermine the FDA's authority and restrict access to safe, evidence-based care that millions of people have safely used over its 25+ years on the market.
In response, Power to Decide Interim Co-CEO, Rachel Fey, released the following statement:
"We call on the Supreme Court to reverse the Fifth Circuit's harmful ruling and stop allowing junk science peddled by abortion opponents to restrict access to a safe, effective, and widely used medication. This temporary reprieve will allow continued access to mifepristone through telehealth for one more week, but one week is not enough - this access should never have been put at risk in the first place and must be maintained permanently.
"Mifepristone has been rigorously studied for decades and is a critical part of abortion and miscarriage care in the United States. Research also confirms that ordering abortion pills through telehealth is just as safe and effective as in-person care.
Restricting access does not eliminate the need for care - it only creates unnecessary barriers, delays, and inequities, particularly for young people, people in rural communities, and those already facing systemic barriers to health care.
