PUBLIC NOTICE OF BALLOT TITLE
Notice is hereby provided that a ballot title for a measure referred by the John Day City Council for the November 3, 2026 General Election has been filed with the John Day elections officer on July 28, 2026.
Caption: Imposes city tax on marijuana retailer's sale of marijuana items.
Question: Shall John Day impose a three percent tax on the sale of marijuana items by a licensed marijuana retailer?
SUMMARY: State law provides that a city council may adopt an ordinance to be referred to the voters of the city imposing up to a three percent tax or fee on the sale of certain marijuana items by a licensed marijuana retailer. The John Day City Council has referred this measure to the voters as provided under state law.
Approval of this measure will impose a three percent tax on the sale of marijuana items by marijuana retailers in the city. The tax will be collected at the point of sale and remitted by the marijuana seller.
Any elector dissatisfied with the ballot title may, pursuant to ORS 250.296, petition for review to the Grant County Circuit Court to seek a different title, no later than August 7, 2026. The elections officer/ city manager must be notified within one day of any petition challenging the ballot title being filed in the circuit court.
