DHS enforcement action advances President Trump's commitment to enforcing trade laws, keeping goods tied to forced labor and mass surveillance out of U.S. supply chains, and protecting American workers and businesses from unfair competition
WASHINGTON - Today, the Department of Homeland Security (DHS), on behalf of the Forced Labor Enforcement Task Force (FLETF), announced the addition of three Chinese companies to the Uyghur Forced Labor Prevention Act (UFLPA) Entity List. The action means goods made by these companies are prohibited from entering the United States unless the importer can demonstrate, under the law's requirements, that the goods were not made with forced labor.
The FLETF determined that these three affiliated Chinese genomics companies help the government of the Xinjiang Uyghur Autonomous Region, a region in northwest China known as Xinjiang, build and operate its mass surveillance infrastructure. The system uses data, derived from genetic material, and other information to monitor ethnic minorities and supports the government's broader repression, including labor-transfer programs and internment, often conducted under the guise of "healthcare." Together, the companies constitute one of the largest advanced gene-sequencing and genetic-material collection enterprises in the world.
"Under President Trump's leadership, we are not going to let companies tied to forced labor and the surveillance of persecuted minorities profit from the American market," saidHomeland Security Secretary Markwayne Mullin. "Today, DHS is barring three Chinese DNA testing companies from allowing their goods to enter the United States unless importers can meet the law's requirements. This is about enforcing our laws, protecting American businesses from unfair competition, and making clear that companies connected to forced labor will not get a free pass in this country."
The Trump Administration is setting high standards for protecting workers at home and abroad by taking tough action to root out forced labor from global supply chains. With today's announcement, the UFLPA Entity List includes 190 entities. This follows DHS's July 31, 2026, announcement adding 43 entities to the list, the largest single expansion since the list was created.
"These companies' behavior shows an unwillingness to separate profit motives from basic codes of human dignity," said DHS Under Secretary for Strategy, Policy, & Plans Rob Law, who serves as the Chair of the Forced Labor Enforcement Task Force."Today, we're taking action to realign those motives - at least as far as the U.S. market is concerned - goods produced by these companies will not be allowed entry unless they can prove that they do not take part in the forced labor apparatus in Xinjiang."
Effective October 29, 2026, U.S. Customs and Border Protection (CBP) will apply a rebuttable presumption that goods produced by these three entities are prohibited from entering the United States as a result of the companies' activities, either sourcing materials from the Xinjiang Uyghur Autonomous Region (Xinjiang, the XUAR) or working with the government of Xinjiang to recruit, transport, transfer, harbor, or receive forced labor or Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups out of Xinjiang.
Credible information, including corporate and government reporting, indicates that all three entities support genetic testing in the XUAR alongside the XUAR government and as a part of its government initiatives. The collection and analysis of genetic material facilitate the monitoring, surveillance, and repression of ethnic minorities by the government of the People's Republic of China, including the abhorrent practice of forced labor.
Today's action also advances the Trump Administration's broader work to enforce U.S. trade laws and combat trade fraud. Ensuring that malign actors are held fully accountable for violations of U.S. customs and trade laws, including the UFLPA, is a key mandate of the joint DHS and DOJ Trade Fraud Task Force, which has realized over $1 billion in penalties, recoveries, and charged losses in its first year of operation.
"The DHS-DOJ Trade Fraud Task Force will be watching for anyone attempting to circumvent today's action, and will prosecute them to the fullest extent," said DHS Assistant Secretary for Trade and Economic Security Aris Kourkoumelis. "Members of the trade community need to understand our resolve and the significant consequences coming for those that would seek to violate the law."
DHS and the FLETF continue to work closely with stakeholders across industry, mission-driven organizations, and international partners to strengthen enforcement and support compliance. Addressing these threats strengthens global supply chains and our economic and national security. Additions to the UFLPA Entity List assist CBP in its enforcement and help eliminate threats to American businesses from foreign competitors' unfair practices.
DHS has published the revised UFLPA Entity List as an appendix to a Federal Register notice.
