ACC Commends Senator Capito for Release of Draft TSCA Reform Legislation
WASHINGTON (February 27, 2026) - The American Chemistry Council (ACC) applauds Senator Shelley Moore Capito (R-WV) and members of the Senate Environment and Public Works (EPW) Committee for releasing draft legislation aimed at improving the U.S. Environmental Protection Agency's (EPA) implementation of the Toxic Substances Control Act (TSCA). The following statement can be attributed to ACC President and CEO, Chris Jahn.
"From energy to healthcare to national security, American success relies on American chemistry, and that means we need a TSCA program that supports innovation, investment, and a competitive U.S. manufacturing base. Senator Capito's draft legislation represents a constructive and much-needed step toward restoring a TSCA program that works as Congress intended.
"The challenges facing TSCA have persisted for far too long. Chemical manufacturers have faced delays, inconsistent decision-making, and unclear regulatory expectations under the TSCA new chemicals review process. This proposal offers approaches to reduce the growing backlog, provide greater transparency, and give American manufacturers the certainty they need to innovate, invest, and compete globally. America will be stronger, healthier and more affordable if we can get TSCA back on track.
"We appreciate the Committee's commitment to strengthening oversight of EPA's implementation of TSCA and to ensuring the statute functions as a modern, science-based, risk-based regulatory framework. A predictable and efficient new chemicals process is essential to winning the race on innovation and maintaining the United States' leadership in chemistry and advanced manufacturing.
