MDARD Updates Commercial Fertilizer Bulk Storage Regulation

LANSING, Mich. - The Michigan Department of Agriculture and Rural Development (MDARD) today announced a modernized approach to commercial fertilizer bulk storage facility oversight that will better protect Michigan's environment while supporting the state's agricultural industry.

"Michigan's commercial fertilizer bulk storage facilities collectively store over 75 million gallons of fertilizer, making comprehensive, up-to-date standards essential to protecting our natural resources from accidental spills," said Mike Philip, Director of MDARD's Bureau of Environment and Sustainability. "MDARD experts worked with industry partners to modernize Michigan's fertilizer regulation in a way that helps fertilizer storage facilities operate safely while ensuring farmers have reliable access to nutrients to produce food for Michigan families."

Michigan Regulation No. 641 governs commercial bulk fertilizer storage. The regulation remained largely unchanged for more than 25 years despite advances in fertilizer storage technology, facility design and management practices. The updates to the regulation reflect these advancements and strengthen safeguards for Michigan's ground and surface waters.

MDARD developed the updated regulation in collaboration with Michigan's fertilizer industry. Working directly with bulk storage firms and industry leaders, the department identified opportunities to modernize the regulation to reflect current technologies, operational practices and environmental safeguards.

Updates to the regulation include:

• MDARD pre-approval before construction of new or expanded bulk fertilizer storage facilities to ensure construction plans align with best practices and requirements.
• Enhanced inspection, maintenance and record-keeping requirements for all bulk fertilizer storage facilities.
• Updated standards for piping systems and related infrastructure that better align with modern equipment, materials and technology while ensuring safety.

Key components of the updated regulation took effect on July 9, 2026. Other changes will be phased in to allow existing facilities to complete necessary operational and infrastructure improvements. MDARD will work closely with the industry throughout this transition, providing guidance and technical assistance.
