Review : The lead agency for this proposal has determined that it does not have a probable significant adverse impact on the environment. Pursuant to WAC 197-11-350, the proposal has been conditioned to include necessary mitigation measures to avoid, minimize, or compensate for probable significant impacts. An Environmental Impact Statement (EIS) is not required under RCW 43.21C.030(2)(c). The necessary mitigation measures are listed below. This decision was made after review of a completed environmental checklist and related information on file with the lead agency. This information is available to the public on request.

Determination: This MDNS is issued under WAC 197-11-340(2); the lead agency will not act on this proposal for 14 days from the date issued. Written comments may be submitted June 13, 2025 through June 27, 2025.

Mitigation Measures:
1. Prior to issuance of the Engineered Grading Permit, the applicant shall submit a Cultural Resource Survey report completed by a qualified professional to the Spokane Valley. In addition to the report, the applicant shall submit evidence of the acceptance/concurrence with the findings in the report from the Washington State Department of Archaeology and Historic Preservation and the Spokane Tribe of Indians.

2. Prior to issuance of an Engineered Grading Permit, an Inadvertent Discovery Plan (IDP) shall be prepared by the applicant and submitted to the City of Spokane Valley. A copy of the IDP shall be kept on site at all times during construction activities.

3. The applicant shall construct an off-street pedestrian connection on the south side of 4th Avenue from the project site to the existing sidewalk at McDonald Road. The pedestrian connection shall include a combination of concrete sidewalk and asphalt pedestrian path and shall accommodate existing drainage facilities in the following locations as described:

  • Along the frontage of 404 S McDonald Road:
    • Extend the existing curb and sidewalk west along 4th Avenue as necessary to accommodate the existing drainage facilities, which may need to be adjusted or relocated.
  • Along the frontages of 13002 E 4th Avenue and 404 S McDonald Road:
    • Construct a 6-foot-wide, asphalt pedestrian pathway along the frontages of 13002 E 4th Avenue and 404 S McDonald Road, consistent with the following:
      • The pathway shall be offset at least 5 feet from the existing asphalt edge on 4th Avenue where possible, subject to accommodation of drainage and construction of the pathway within the existing right-of-way.
      • Where the pathway is adjacent to the existing edge of pavement, the pathway shall have a 4-inch-deep thickened edge. The elevation of the north edge of the pathway when adjacent to the existing edge of pavement shall be constructed level with the edge of the existing asphalt and shall slope to the south at a 2% down gradient.
      • Where the pathway is located 2 feet or closer to the existing edge of pavement, City approved plastic delineators shall be installed spaced at 25 feet on center starting 50 feet prior to the 2-foot offset and extending 50 feet past the 2-foot offset.
      • The pathway shall consist of 2-inch Hot Mix Asphalt (HMA) Class ½" PG 64-28 over 6" Crushed Surfacing Top Course (CSTC), except at driveway approaches where the pavement thickness shall be increased to 3 inches.
      • The pathway shall connect to the extended sidewalk west of the intersection of 4th Avenue and McDonald Road.
      • A 1-foot deep by 3-foot-wide pervious gravel shoulder shall be installed between the south edge of 4th Avenue and the north edge of the asphalt pathway. The pervious gravel shall consist of 3-inch minus ballast approved by the City.

Appeal: An appeal of this determination shall be submitted to the City of Spokane Valley Economic Development Department within 14 calendar days after the date issued. Appeals may be submitted from June 13, 2025, through 4:00 p.m. on June 27, 2025. The appeal must be written and specific factual objections are made to the City's threshold determination. Appeals shall be conducted in conformance with Spokane Valley Municipal Code (SVMC) 17.90 Appeals, and any required fees pursuant to the City's adopted Fee Schedule shall be paid at the time of appeal submittal. Pursuant to WAC 197-11-680, appeals shall be limited to a review of a final threshold determination.
