ANACOM has published its report on the open Internethttps://www.anacom.pt/render.jsp?contentId=1813247, reflecting the supervisory and monitoring activities carried out by the Authority between 1 May 2024 and 30 April 2025 with regard to the application of articles 3 and 4 of the Regulation (EU) 2015/2120 (UE)https://www.anacom.pt/render.jsp?contentId=1373317 of the European Parliament and of the Council of 25 November 2015 (the Open Internet Regulation), also following the Guidelines of the Body of European Regulators for Electronic Communications (BEREC) for its implementation https://www.berec.europa.eu/en/document-categories/berec/regulatory-best-practices/guidelines/berec-guidelines-on-the-implementation-of-the-open-internet-regulation-0.
During the period under review, ANACOM carried out a number of activities, including monitoring the information published by Internet Service Providers (ISPs) on their websites and the information included in the copies of contracts filed with ANACOM, in compliance with paragraphs 1 and 2 of article 121 of the Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=1737530, in order to ensure the transparency of the information provided to end users, as has been the practice in recent years.
ANACOM continued to receive and analyse complaints sent directly to the Authority, including those relating to Internet access services (IAS).
ANACOM continued to use NET.medehttps://netmede.pt/ as an important tool for monitoring IAS quality, regularly releasing reports on the main results of user-conducted tests.
Finally, it is worth highlighting the work carried out with the ISPs with the greatest market representation between the end of 2024 and the beginning of 2025, with a view to promoting greater transparency of the information provided to end users, in compliance with article 4 of the Open Internet Regulationhttps://www.anacom.pt/render.jsp?contentId=1373317. This work covered both their websites and their contracts.
Within the scope of its duties relating to the application of the Open Internet Regulation, this Authority will continue to monitor its implementation, which will involve monitoring the commercial offers of ISPs, the information disclosed on their websites, and the contractual conditions applied. It will also involve analysing the complaints received from end users to identify the main difficulties they are facing.
This report, as well as its submission to the European Commission and the Body of European Regulators for Electronic Communications (BEREC), was approved by ANACOM decision of 25 June 2025.
