Gillibrand Applauds Committee Passage Of Her Bipartisan Legislation To Protect Living Organ Donors

Feb 26, 2026

Legislation would promote organ donation by protecting living organ donors from financial and employment-related barriers

U.S. Senator Kirsten Gillibrand issued the following statement following the passage of her legislation, the Living Donor Protection Act, out of the Senate Committee on Health, Education, Labor, and Pensions (HELP). The Living Donor Protection Act would ensure living donors do not face discrimination from insurance companies, codify Department of Labor (DOL) guidance that covers living donors under the Family Medical Leave Act (FMLA) in the private sector and civil service, remove barriers to organ donation, and provide certainty to donors and recipients.

"It is heartbreaking that so many Americans die while waiting for the lifesaving organ transplants they need. My Living Donor Protection Act will encourage organ donation by making sure that people who are willing to donate can do so without jeopardizing their job security and facing barriers to insurance coverage. I am proud to see this legislation pass out of committee, and I encourage my colleagues in Congress to bring it to a vote immediately."
