Santa Ana City Council approves new regulations for smoke shops to protect public health

The Santa Ana City Council approved new rules to regulate smoke shops in Santa Ana on Tuesday, March 3, 2026, to protect public health, improve neighborhood safety, and prevent overconcentration of smoke shops.

The City Council approved a zoning ordinance amendment that updates Chapter 41 of the Santa Ana Municipal Code relating to smoke shop establishments. The ordinance:

  • Establishes a definition of smoke shops
  • Requires new smoke shops to obtain a Conditional Use Permit (CUP)
  • Limits where smoke shops can open
  • Establishes development and operating standards
  • Requires annual inspections

Since January 1, 2024, the number of smoke shops in Santa Ana has increased from 17 to 43 locations (38 licensed and five unlicensed).

  • About 96% of all documented smoke shops are located near neighborhood retail centers, which raises concerns about public health, safety, and enforcement.
  • Nearly 60% are within 1,000 feet of youth-centered uses, such as schools, parks, and childcare facilities.
  • All but two are within 500 feet of residential areas.

The new ordinance now creates distance requirements, or "buffers," including:

  • 1,000 feetbetween smoke shops and youth-centered locations
  • 500 feetbetween smoke shops and residential areas
  • 1,000 feetbetween smoke shops to prevent clustering
  • 300 feetfrom major arterial streets

Under the new rules, existing smoke shops may continue operating if they have a valid Certificate of Occupancy and Tobacco Retailer License. Nonconforming shops must comply with new operating and development standards within six months.

The City Council also adopted a resolution establishing new annual inspection fees to cover the City's costs:

  • $533.08- Planning and Building Agency inspection fee
  • $709.98- Police Department inspection fee

The Planning and Building Agency and Police Department will conduct joint inspections at least once per year. Inspections will review compliance with operating standards, and any evidence of criminal or nuisance activity.
